These terms govern your use of the Indoor Elements Mechanical Ltd. website and our communications and services. Please read them carefully — by using our website or engaging our services, you agree to them.

1. Agreement to these terms

These Terms of Service (“Terms”) are a legal agreement between you and Indoor Elements Mechanical Ltd. (“Indoor Elements,” “we,” “us,” or “our”), located at 8549 112 St, Grande Prairie, AB T8V 6A4, Canada. By accessing or using our website at https://indoorelements.ca, contacting us, or engaging us to perform services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use our website or services.

2. Our services

Indoor Elements provides residential and commercial HVAC, plumbing, and electrical services in the Grande Prairie and Peace Country region. Information on our website is provided for general informational purposes and does not constitute a binding quote, professional advice, or a guarantee of availability. The specific scope, price, warranty, and terms of any work we perform for you are set out in the estimate, invoice, or service agreement we provide for that job, which together with these Terms governs that work. Where a signed service agreement or estimate conflicts with these Terms, the service agreement or estimate controls for that engagement.

3. Estimates, scheduling & payment

  • Estimates are based on the information available at the time and may change if conditions, materials, or scope differ from what was expected. We will communicate material changes before proceeding where reasonably possible.
  • Appointment times are estimates and may be affected by weather, emergencies, parts availability, and prior jobs running long.
  • Payment is due as stated on your invoice or service agreement. Financing, where offered, is provided by a third-party partner and is subject to that partner’s separate terms and credit approval.
  • Unpaid amounts may be subject to interest and reasonable collection costs as permitted by law.

4. Cancellations

If you need to reschedule or cancel an appointment, please contact us as early as possible. Cancellation, deposit, and restocking terms, if any, are described in the estimate or service agreement for your job.

5. Communications & electronic messages

By providing your phone number or email address, you agree that we may contact you about your inquiry, estimate, appointment, and service using phone calls, email, and text messages. Some of these communications are necessary to provide the services you have requested.

Text messaging (SMS / A2P) terms

  • We send text messages using application-to-person (A2P) messaging through a third-party provider. Today we primarily use text messaging to send review requests after we complete service, and we may also send service-related messages such as appointment confirmations, reminders, and updates.
  • We send commercial text messages only where we have your consent or another lawful basis under Canada’s Anti-Spam Legislation (CASL). Consent to receive marketing texts is not a condition of purchasing our products or services.
  • Message frequency varies. Message and data rates may apply depending on your mobile carrier and plan.
  • You can opt out at any time by replying STOP to any text from us, and you can reply HELP for assistance. After you reply STOP, we will stop sending texts of that type, except as needed to process your request or as otherwise permitted by law.
  • Every commercial message we send identifies us and includes a way to unsubscribe. We honour opt-out requests within the time required by law.

6. Acceptable use of the website

You agree not to:

  • Use the website for any unlawful purpose or in a way that could damage, disable, or impair it.
  • Attempt to gain unauthorized access to any part of the website, its servers, or related systems.
  • Use automated tools to scrape, harvest, or collect information from the website without our permission.
  • Submit false, misleading, or fraudulent information, or impersonate any person or entity.

7. Intellectual property

The website and its content — including text, graphics, logos, images, and the Indoor Elements name and marks — are owned by or licensed to Indoor Elements and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

Our website may link to third-party websites and services, such as our financing partner, mapping, review, and social media platforms. We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of third-party services is governed by their own terms and privacy policies.

9. Disclaimers

Our website and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components. This section does not limit any warranty expressly provided in a signed service agreement or required by applicable consumer-protection law.

10. Limitation of liability

To the fullest extent permitted by law, Indoor Elements and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the website. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for matters expressly covered by a service agreement or warranty we provide. Our liability arising from work we perform is governed by the applicable service agreement or estimate for that work.

11. Indemnification

You agree to indemnify and hold harmless Indoor Elements from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the website or your breach of these Terms, to the extent permitted by law.

12. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in Alberta for any dispute arising out of or relating to these Terms, except where applicable law provides otherwise.

13. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will revise the effective date above and post the updated Terms on this page. Your continued use of the website or our services after an update means you accept the revised Terms.
